Teenage Claim

 

Our firm obtained a judgment of $ 4,005,981.00 in the wrongful death of a 17-year old high school student who was killed by the reckless driving of another teenager.  Our client’s daughter was the passenger in a car that was driven by a friend, who decided to race and play games with another vehicle on the roadway.  Their vehicle flipped over, killing our client’s daughter instantly.  Our firm was not only successful in obtaining a verdict against the driver of the vehicle.  Due to our diligent investigation, we were also able to identify the driver of the other vehicle involved in the race, and we secured a policy-limits settlement with that insurance company as well.

 

 

Infant Claim

 

Our firm obtained a confidential settlement in the case of the wrongful death of an infant killed at an in-home daycare.  The infant, an 18 month-old boy, opened a sliding glass door, walked outside, and fell into the pool where he drowned.  His parents sought our assistance in holding the owner of the daycare financially responsible for his death.  We successfully settled with that insurance company.  We also assisted the parents, at no additional cost, with an administrative complaint against the daycare center which resulted in their license to operate a daycare being revoked.  We then brought suit against the corporation that installed the pool at the daycare, on the theory that they knew the house was used as a daycare yet failed to install proper fencing around the pool.  That claim was also settled for a confidential amount.

 

 

Elder Neglect Claim

Our firm successfully settled a wrongful death claim, in a confidential amount, on behalf of an elder, who passed away in a skilled nursing facility as a result of septic infection caused by bed sores.  The case was brought under California’s Elder Abuse Law, which allows recovery for the elder’s pain and suffering, attorneys’ fees and other damages.  Our firm, working with experts in the field of nursing and geriatric medicine, demonstrated that proper observation of the worsening condition would have resulted in hospitalization at an inpatient facility, and a cure of her overwhelming infection because it became untreatable and fatal.

Construction Personal Injury Claim

We represented and obtained a settlement of $440,000 in a personal injury case involving construction material that was not properly tied down in a truck and subsequently was dumped out onto a major freeway.  The car directly behind the construction truck managed to avoid the debris; our client struck the rear of the vehicle that managed to avoid hitting the debris.  We received a lump sum payment for our client, plus an annuity that will pay him a considerable amount every month for the rest of his life.  He was 37 years old at the time of the accident.

 

 

Elder Abuse Financial Claim

Our firm has also obtained judgment under the Elder Abuse Law setting aside a real estate deed and for monetary damages against an in-home daycare provider for our elderly client.  Our client, who was easily confused and suffered memory problems, was unduly influenced by his caregiver.  The caregiver obtained a quit-claim deed to some property that our client owed.  With our help, we were able to secure a judgment setting aside that deed and awarding monetary damages against the caregiver for $89,000 for financial abuse.
